Terms of Service

Plain English first. We want you to feel comfortable doing business with us. These terms exist to protect both of us and set clear expectations β€” not to create barriers. If you ever have a question or concern, just call or text us at 310-923-5603.

1. Who We Are & What This Covers

These Terms of Service cover your use of DigitalService.Agency and any services you purchase from us. By placing an order you're agreeing to these terms, which is pretty standard for any professional service. We're a US-based digital agency β€” a real person answers when you call.

2. What We Do

We provide digital services including:

  • Paid advertising management β€” Facebook, Instagram, Google, YouTube, TikTok, LinkedIn, Bing, Reddit, and more
  • SEO β€” audits, strategy, backlinks, content, and ongoing management
  • Web design and development β€” websites, mobile apps, e-commerce, and custom software
  • Website maintenance and support

Everything we deliver is digital. Nothing physical is shipped.

3. Pricing & Payment

Prices are shown upfront on our website β€” no hidden fees. Payment is collected via PayPal before we begin work. For monthly services, your subscription renews automatically each month until you cancel. Ad budget you spend directly on platforms like Facebook or Google is separate from our management fee.

4. Our Work Policy β€” Please Read

Because all of our services involve real time, labor, and third-party costs (ad accounts, backlink placements, content production), we're not able to offer refunds once work has started. This is standard across the digital services industry β€” the same way a plumber, designer, or copywriter wouldn't refund hours already worked.

Specifically, this applies to:

  • SEO campaigns after strategy work or any deliverable has been provided
  • Ad campaigns after they've been set up or launched
  • Website or app projects after design or development has begun
  • Any report, audit, article, or backlink once delivered
  • Any partial month of a monthly subscription

We stand behind our work. If something isn't right, please reach out to us directly β€” we'd much rather fix an issue than have an unhappy customer. Initiating a payment dispute for services properly delivered isn't something we can accept, and doing so may result in us pursuing recovery of costs.

5. Cancelling a Monthly Plan

Cancel anytime β€” no long-term contracts. Just let us know at least 5 business days before your next billing date by calling, texting, or emailing us. Your service continues until the end of the period you've already paid for.

6. Your Ad Account Access

For advertising services, we'll ask you to grant us partner/admin access through the platform's official settings (e.g. Facebook Business Manager, Google Ads user access). We never need your password and will never ask for it. You stay in full control of your account at all times.

7. Who Owns the Work

Once you've paid in full, everything we created specifically for you β€” code, designs, written content β€” is yours. We may show it in our portfolio unless you ask us not to within 30 days of delivery. Any tools, templates, or frameworks we brought to the project remain ours.

8. What We Need From You

To do our best work, we ask that you:

  • Give us accurate information about your business and goals
  • Reply to our messages within a few business days so we can keep things moving
  • Grant us the platform access we need to do the job
  • Only provide legal content for us to work with

9. Results & Expectations

We're honest about what we can deliver. SEO and advertising results depend on your industry, competition, budget, and many other factors β€” some outside our control. We don't promise specific rankings or a specific number of leads, but we do promise to work hard and communicate clearly. The case studies on our site reflect real results from our own projects, not guarantees for yours.

10. Our Liability

If something goes wrong on our end, our liability is limited to the amount you paid for that specific service in the past 30 days. We're not responsible for indirect losses like lost profits or missed opportunities β€” again, standard for any service provider.

11. Governing Law

These terms are governed by California law. If there's ever a dispute we can't resolve by talking it through, it would go to binding arbitration in California rather than court.

12. Updates to These Terms

We may update these terms occasionally. When we do, we'll post the new version here with an updated date. Continued use of our services means you're good with the changes.
